Im not sure on the legal side of it but i spoke to a very well known street artist recently who was looking at going after people/companies that had used his images in publications and film with no permission. Didn't realise you could do that if it was just a picture of a street piece, seems like you can. I guess it depends on the context, based on what he was saying, i think you would have a case. Depends if you can be arsed. That image of yours has got to be the most wrongly identified Banksy image ever.

Laws are different all over the world, but don't street artists own the copyright and reproduction rights to their works? Some artists might not be able to go to court, but I mean, don't they need permission to publish your work?

My understanding is tha the creator of a piece owns the copyright, even in the case of commissioned work. Obvs, there is the 'Fair Use' argument, which is how the prick Fairey gets away with fucking murder... I think the cases you are remembering are t shirt designs, flagrantly stolen. However, I think the most important thing is to remember- every image sharing site you use, every app, every little bit of creativity is stolen from you. Instagram it? They own it...

Well I'm not a lawyer (or a doctor bizarrely), but if you're taking things down a legal route, it's probably best if you don't make any further comments for now FAKE.
I do think artists should seek fair credit for their work though. Especially when others are making money off the back of artists without their knowledge or permission.

Manuel, you have a great PR opportunity here like hayuk and starbucks. Get your lawyer to sue Banksy, it will be worldwide news and you'll be famous overnight. papers will lap it up. Send a writ to jo brooks, she'll probably promote it :-). Coincidently my fake pieces will sky rocket :-)
